If the contract includes an obligation by the dealer to supply an item in a given (or perhaps "reasonable"?) timescale, which the dealer can no longer meet, then presumably they can be held in breach by the purchaser too? Technically all that can be retained from the deposit are reasonable costs incurred by the dealer. As the dealer holds the deposit in full and Lotus haven't built/delivered anything that shouldn't amount to a lot.

Sounds brilliant, but they still haven't said anything about when they are getting built... No production schedule or anything so punters are still waiting blindly for something concrete to stop them cancelling orders!

Im sure its because they dont know.
