If you have signed a new car order form you have effectively entered into a legally binding contract to purchase a car

If you cancel , the dealer may keep the deposit as they are left with a car that was specc'd to your requirements
Not only is the dealer entitled to retain the deposit, he is also entitled to sue you for breach of contract and the balance of the sale value.

A simple phone call to the dealer may get a sympathetic ear as in the instance of the new model, they will not meet the delivery dates as their is no indication that the build is starting any time soon

:cheers
If the contract includes an obligation by the dealer to supply an item in a given (or perhaps "reasonable"?) timescale, which the dealer can no longer meet, then presumably they can be held in breach by the purchaser too? (Shades of Mercantile Law lectures drifting back...but it WAS a long time ago!)

Technically all that can be retained from the deposit are reasonable costs incurred by the dealer. As the dealer holds the deposit in full and Lotus haven't built/delivered anything that shouldn't amount to a lot.

I'm with Campbell. There is a reasonable timescale (Scottish common law - poss Sale and suuply goods ands services) within which the contract must be honoured.
Or to put it another way there are 2 sides to a contract...

FINAL TESTING OF THE EXIGE S IN HETHEL: Jan Hoel asked the question where the improved laptime - 5 seconds faster than the old Exige Cup 260 - comes from:
More power
More torque
Better power/torque to weight ratio
Higher lateral acceleration
Courtesy of suspension improvements and new Pirelli tyres
Better braking – courtesy of Pirelli tyres and new brake system
New race mode which optimises traction

Sounds brilliant, but they still haven't said anything about when they are getting built... No production schedule or anything so punters are still waiting blindly for something concrete to stop them cancelling orders!

Im sure its because they dont know.

Be worth the wait im sure, and by the time you get it you would have saved up some extra money for some spare tyres
