For the PF to put it to the courts he has to be served with an inditement, ie what charges he will face when it goes to court, so he will hear within the 6 month period. Lot of confusion re issues like this when people don't really know what they are talking about.

You are correct, there is a lot of confusion when people don't know what they are talking about :lol:

The PF have to lay information with the court within 6 months, they do not have to notify the 'defendent' within 6 months....... however, you would more than likely hear within 7 months of the offence date as previously covered in theis thread :thumbsup

Not that I think it is warranted in this case, but presumably if you wanted to find out whether or not the papers had been lodged at the court you could lodge some sort of request with the court to notify you in the event of any case being lodged with you as the defendant - I'm sure we did this a long time ago when there was a worry that an ex-employer might try to spoil a new venture ... of course this approach costs money.

Crumbs - must have been some offence for an indictment to be needed here...

I think Neil knows where he stands - naughty boy and he'll find out in the fullness of time. No point worrying about things you can't change and advice can be taken at the appropriate time. If there are any concerns about it, make a note of everything now to jog your memory should you need it for later.

That's called a caveat - you lodge them either with the Court of Session or in Sheriff Courts to inform you of when someone tries to lodge an application for, say, interim dilligence where only the Pursuer (i.e. the one bringing the action against you) has a hearing before a Judge that could prevent you from disposing of your property. As far as I'm aware there's no such thing in the Criminal Courts, as there's no way you can be 'done' without having prior knowledge of it.

Apologies for straying from the topic a bit, but am I right in reading/understanding that if they stop you for doing a little over the limit, you can immediately get a bit paper with the choice of 3 points and a fine, or disputing, BUT if they do you for dangerous driving, you potentially have to wait 6 or 7 months before being given a date on which your fate is decided, during which time you can, of course, be out there dangerous driving as much as you like? :?

Only had one experience like this before - and from a decent pair of traffic police as well. If they have stopped you and haven't issued you with a fixed penalty - either they tell you that you are getting off with it or that the offence is too severe for them to issue you with an on the spot fine/points and you will hear in due course.

A nervous wait in store I'm afraid - however a well constructed and apologetic letter stating road conditions, rarity of your actions and remorse and understanding towards the chaps who have to clear up the mess goes a long way. Lame excuses for why it happened won't cut it IMO.

FWIW I didn't hear for a few months and then the dreaded brown envelope appeared.

Best of luck - and hopefully if there is no history there you will be OK.

Happened to me a few years ago and they told me at the time it was going to fast for a fixed penalty (was kinda worried it was going to be my passengers old man as he used to patrol the M77) A few weeks later I was made an offer £60 and 3 points, so wrote my letter pleading guilty and on the day I was going to post it I got a letter from the fiscal telling me the court staff where on strike and another date would have to be organised, should I not hear anything in the next 6 months the case has been dropped.

2 months later I passed a scamera on roadworks on the M8 at 4am (it was posted 40 I was doing 50) I am sure the national speed limit sign would have been in my photo's as the cones had all dispaeared etc. Git's
