Gareth - sorry for hijack!

Graham & Rob - Thanks for the input. Prob for me is an unknown quantity. Would like to raise one for less than £750 (obvious small claims expenses) and then serve a Spec to recover the bank statements without the charges. Then.. If I remit up to Summary Cause, things could get expenseive if its a test case! Still, doubt its 750+ in charges, but wonder how the Sheriff Court would be about a non-specific principal sum in what's technically a Contract case!

Letter before action it is then...

Greg I recon the way to go would be to pick a relatively low figure (even if it is just a best guess) and proceed with the spec. When you have the info you can amend the sum sued for up the way and if necessary raise multiple actions within the £750 limit to avoid the risk of summary cause expenses. No rule on unum quid in contractual claims (I don’t think). Probably a slight risk of being accused of abusing the SC rules but don’t think the risk is significant and you are allowed to in any event.

Reality is that if you have to fight one case then they will settle any other.

You might even recover the cost of that C/R box.

Miraculously reappeared in my account.
Online banking says it was paid back in the same day it was stolen. Bank must of just back dated it.

Bank Charges Reclaiming. Payouts may be cut. Act now!
In April, the Office of Fair Trading will give its opinion on the appropriate amount for bank charges. My guess is it'll be £12, though the banks predict higher and I think it should be lower. The banks will be under huge pressure to drop charges across the board, and will probably fall into line. This won't stop people reclaiming past charges, however banks may only offer the difference between £12 and the amount you were originally charged (e.g. £35 - £12 = £23). If you don't accept it, the risk they may defend in court for the first time, citing the OFT ruling, is a tiny bit higher. To avoid all this, reclaim now!

BOS have been given scary Greg letters, resulting in my getting put through to an human being on Monday.

Him: "how much are you after?"
Me: "dunno, need all my bank statements sent to me free for the last 5 years."
Him: "I'll send those out to you, life then becomes a lot easier."

I'll keep you posted of developments, but initial signs are positive. Will also be sneaking in a wee £50 for 'general inconvenience!' :)

Update as promised:-

Following on from Monday's telephone conversation with the human at BoS, I received my statements last night. Went through them with a highlighter and noted £656 of charges over the last 4 years :shock:

Called the chap today and spoke to someone else. Asked for my £656 back, and she advised we would need to 'compromise' as technically my account hadn't been managed properly by me (fair point). I said OFT entitle the bank to £4 per charge, so would be prepared to lower my figure by £76 (19 charges in total). 2 minutes later, offer accepted!

I'll be sent a formal acceptance through the post, and will receive the spondooliks within 14 days :D

Job's a parsnip!

If Anyone needs help/advice with their own charges - let me know :thumbsup

What sort of things incur bank charges? I don't remember seeing a single one, but then again I rarely scrutinize my bank statements!

Bear in mind I'm a good boy and don't spend money I haven't got :lol:

I love the way HBOS charge you for a "paid item" so something that takes you overdraft limit - £30. They then charge you for going over your overdraft limit!!! WHICH IS THE SAME FREAKING THING!!! £28.

So if you switch something that brings you 50p over your limit thats £58.

Greg did you do yours mostly over the phone? I'm going to nip into my branch at lunch to ask for my statements.

3 letters to start with addressed to the bank manager. First 2 resulted in fob-off tactics, third resulted in an offer of 'goodwill' of £39 refund. After that, a further letter threatening court action that prompted a letter from the human asking me to call him :)

If they try to charge you for statements - take none of it :)

Well done Greg on getting your money back from BOS as well. Guy who phoned my ex tried to fob her off with lower payment but I had told her to take none of it. Just told her to remember the way the bank staff treated her when she tried to get charges that were building up because of previous charges sorted out, and they wern't interested in listening.
