Aww mate, that's a nightmare. Only just seen this. Glad you're ok!! what a lovely car it was and what a thoroughly good steed it has been. Hope you get a resolution quickly. I am looking forward to the 'What Kinger did next!" thread. :)

That is why we should never have scrapped Capital Punishment.

It should make no difference Graham, your Insurance Company must still treat it as a no fault accident and you should not be charged your excess. There is also a Fund now to cover non insured drivers causing injury.

Hopefully he owns the car so at least your insurer can sue him for the money it will cost to fix your s1.

On a better front, was down to look at the car late this afternoon. In the light of day it isn't quite so bad as I first thought. Both Clams and passenger side sill are U/S. As for the rear suspension it look like its the top ball joint that has sheared. Wish bone location doesn't look damaged but hard to tell for certain. The Other side rear which took the impact would need at least a wheel and wheel bearing / ball joints etc changed. A lot of what I thought was damage on the body was piles of mud that had been deposited on the car. Looked like damge in the pitch dark.

The front end wasn't quite as bad either, the wheel wouldn't turn and it looked like it had been pushed back, but it was jammed by a big lump of wood the it must have pick up on the verge.

Pretty sure it will be written off, but I'll wait and see.

And now the good news, I'll be picking up my Elise 220 Cup a week on Saturday. Elise is dead, long live Elise!!!!. That'll give me something to smile about waiting for the insurance to get sorted :D :D :D

I'll get some pics of new car up later.

Just read back and saw your post about him not being insured. I had a similar issue around 10 years ago when a van ran into me. Other drivers insurance checked out and Police were satisfied it was all in order but turns out he was driving his fathers van on his car insurance under 'driving other vehicles' and as it was a van it wasn't included so the insurer didn't want to know. After about 6 months the fathers policy eventually paid out so my insurer then refunded my excess and accepted it as a no fault claim.
The lads family were all cross insured on each other's vehicles to ensure they paid minimum premiums. Within the law but unlikely to provide proper cover. Hope you get it sorted.
