Argh....

Just got a NIP through the post.... apparently doing 53 in a 40 on the Queensferry Road just after the Burnshot Flyover heading into Edinburgh...

The thing p*ssing me off is that I saw the van with the mobile camera about a mile away, and as I passed into the 40 limit... made sure I slowed down to 40.... I may have been nudging 50ish as I entered the zone but was slowing down at the time.. anyone know what the range of the cameras is?????

I was also being overtaken at the time by a saab doing 70ish so hope they got one too!

3pts on the licence then .... motherf***ers.... it was a fecking dual carriageway with good visibility and I was keeping up with the flow of traffic.... feckers..... wouldn't mind so much if I had been driving like a hooligan or something..... but I bloody wasn't!

Just checked the calibration certificate and it only tests up to 100m.... I was definitely not doing over 40 by the time I got that close.....

Gonna be asking for a photo methinks.....

Challenge and see if they provide evidence (video not piccies) 7 days before court, not admissable if they don't and even if you don't ask for it. Even if they do then they must prove the distance from the gun to your car, if >100m or unprovable, no problem.

No, don't ask for it, if they don't provide it then it's inadmissable.

I'll try to remember where I read that.

I just liked having a full clean license...... 4 years now that points stay on..... bast*rds.... :evil:

Hoping 3pts won't make too much difference to my insurance etc.... :evil:

Agree with Richard.

Personally I'd challenge, but not request the evidence as the police rarely send it to you on time. Therefore when it gets to court it'll be thrown out as you have not had at least 7 days to look over the evidence and compile your defence.

IIRC they can't just target everyone, they have to use their judgement as to whether you are speeding or not then they can zap you. I'm sure if you dig about it's something about your human rights that they can't just target everyone. Definitely ask for the photo or take it to court.

Just remembered pretty sure its this months Top Gear mag (which I have left at the g/f's)

The plod are required to disclose all evidence to the defendant 7 days before trial. You do not have to ask for it and they must disclose exactly what they want to submit as evidence.

If they provide pictures they must have a means of confirming your speed (Like a GATSO's calibrated lines) and a time code. (Speed=Distance/Time :wink: )

A video must have a similar means of judging speed (Difficult w/o knowing how far apart things are on the road) or the (Calibrated and in date!) speed gun reading. Interesting if the speed gun is not calibrated over 100m, reasonable doubt? I don't know.

Why not ask for clarification about the speed gun calibration? If you can catch them being flexible with the truth in print the Sun will pick up the tab...! :thumbsup

All only valid if you haven't returned the NIP yet. Also look up PACE statements on PePiPoo.

Yes Ed... my PW does do over 40...!! You must have a short memory thought... that was the day I was chauffering you and the luverly Amy around in my .... what did you call it again..... ah yes... my Poncey Merc!!!

Got the calibration cert already.... only goes up to 100m ... so if the photo shows me at 100m + ... could be interesting....
