Fixed Penalty Advice

Post by craignicol » Mon Jun 21, 2010 11:13 am

Guys,

On friday evening I nipped down to Inverurie to pick up some Pizzas and must of stopped on the zig zags outside the Pizza shop on WEST High Street.

I got pulled as i moved off and given a fixed penalty slip thing stating that I have 3 points and a £60 fine to pay within 28 days.

However, the police have written the ticket for the High Street Inverurie (Opposite No 34)
Thats is nowhere near West high street (Opposite No 34) where the pizza shope is, also nowhere near any zig zags!

Have I a case here?? If so how would i appeal it?

Thanks in advance.

If the information is incorrect you can try and have the ticket voided, however they then may just report the circumstances to the PF (quite unlikely though).

My only question is? If you did it.....why fight it?

you can try but very unlikely, the information on the ticket can be changed by the police officer that wrote it if they later discover their mistake

in court the police officer will confirm that your car was parked on the zig zags (at the correct point of the road) and that they made a mistake in the writing of the ticket.... no 'get-out' I'm afraid.

I'm with Meatball on this - take the hit. If you fight it you may need to go to court to plead not guilty and may well end up getting a heavier fine than the fixed penalty. Is it worth the time and effort - would you admit guilt and pay up if it was correct? I would get it over and done with and mark it down as lesson learnt. :|

I agree with you all, I was in the wrong however 3 points on a clean license is a little harsh. Inverurie at night is not like Union street on Saturday morning!

Probably will just take the hit, but I have heard a lot of people trying their luck. (In my opinion worth a go!)

Why not write to them and explain that there is an errror in your ticket as the location stated has no zig-zags. See if they amend it or bin it.
Basically you cannot sign it as that would be a false declaration (In itself illegal - no?) as you were not parked at that address at that time.
Worth a try and you have done nothing illegal then... still sucks though

Creating a false article is what we know it as in the military aircraft world: signing something that is either impossible or not carried out.

Yea that is the approach I would take.

Don't deny what you did. Obviously do not admit it. However write in explaining that you were not near that location at that time, and even at that location their are no zig-zags. That way you are just argueing that the ticket is false not that you were not in the wrong. You are probably more likely to have success with this approach. All depends on how much they want to do you.

I would always try to avoid points, and always have since the day after I passed my test as I learned my lesson there.

Good luck what ever you do.

remember that the clock is running though.....

if they send you a letter back stating that you can argue your case in court and you subsequently want to reply back to pay the £60 and accept the points, if it isn't received in time, it will go to court and you will probably get an increased fine.

I didn't know that parking on the zigzag lines would land you with 3 points  fair enough dishing out a fine. I know they normally put them outside schools etc. where there are alot of people walking around but surely they could of let you off with a warning in the evening when it was alot quieter.

3 points aren't the end of the world and it most likey won't do anything to your insurance. I'm up at 6 points just now and my insurance is still ok, think it only went up by £50 over the year.

You can park on certain Zig Zags at certain times. There are some on Esselmont Avenue in Aberdeen outside a school which I used to park on at nights and weekends and never got a ticket. The traffic warden just kept walking so it's obviously fine. He once issued me with a ticket 5 minutes after my paid parking ran out and ten minutes after I got to my car. Couldn't believe it.

Dad doesn't know about that one though so shhh.

I told you it was glugging it something unreal.

Anyway only parking ticket I ever got compared to Clare. Was last year ana.

Back to petrol, since I was in the turbo band all the time so I could keep up then it was drinking it. As it does, this is massively down to the re-map apparently. Better fuel consumption at the low end, but when in the high end it's far worse.

Think I was using twice ass much fuel as Craig when covering the same distances.

Parking on zig-zag cannot be legal at any time of day and night. That's like saying it's legal to drive through red lights late at night.

The parking warden is ignoring it because it's not his domain ... in the same way as he cannot do you for speeding.

Cheers,
Robin

Ah right didn't know that.

Police go by their all the time though and all residents park on it. There could possibly be a sign beside it, I will have a look and find out.

Anyway good to know it isn't allowed.
