Seems I was going rather quick....with perticulars of the incident to be sent to the Fiscal.

I was issued with no ticket or paperwork????

They had spotted me on the old A1 stopped ( I was adjusting tire presures at Gladsmure) it would seem they were behind me through Haddington where my driving was "exemplary" I was told . Heading out of Haddington I did'nt notice them and headed home I overtook a Micra on the short white lines with plenty of vision and gave the 160 A flick of the right foot Next thing a Audi right up my chumff. I did a Walshy stile left turn with indecatior ON into the side road to let the Audi by so i COULD GET OUT ITS WAY. It was obviouse he could not turn in as quickly as me and complained about how I could turn in so quickly ie dangerously .
As I nipped down the side road the lights came on, I kept going untill I had passed the farm and parked in a save place.. and we had a chat....

Neil, what was the speed limit on the road, and what speed did they tell you were you doing? Was it with a radar gun, or did they follow you and clock your speed over a distance?

if they want to do anything then you'll get a NIP in the next 14 days to at least give them the option of prosecution. And typically you'd only get paperwork if they wanted you to produce any docs etc, so were serving you with an Sp30 or similar.

I suspect this was probably the dark blue A5 that I saw on the bypass who had just pulled someone over.
Was it dangerous/ careless or speeding noops?!

sorry but I have to disagree and hopefully Shug will confirm...... but you now have the '6 month' wait (unless they decide to deal with it by fixed penalty (although i doubt it from what you've said)) as they have already given him his NIP at the side of the road
they have 6 months to get the paperwork laid at court starting from the day you were stopped and given Notice that they Intend to Prosecute.
Did they say what they would charge with? If it is excessive speed did they advise what speed? did they mention careless? did you cross any solid white lines?

Also, its 6 months before they have to put it to the courts, so you may not hear back for nearer 7 months..

Stand to be corrected, but from experience if they are going to charge you, then they will issue with an NIP at the time, which if you were within a certain speed band for the road will be a fixed 3 points, £60 fine, payable within 14 days if you do not contest it.
If you are above that band, ie 95-100 on a 70, you will be charged and issued with a NIP which will be a Court Summons at a later date, and you will learn your fate there. Above 100 usually a charge of dangerous driving and a Court case.
As far as I know, if you were not charged at the time and read your rights, you will hear nothing else from it. It seems a bit vague Neil, either they gave you a warning for being a bad boy, don't do it again, or one of the above would apply. Been there often enough, and this has always been the case.

Karl, the six months does apply for the police to put it into the PF, but for a straight forward speeding offence they would do it between 5 and 14 days or they get their wrists slapped. If they do this then he can sit on it for upto 3 years, but this only really applies in serious cases where they have to tie up witnesses for further statements, appearances etc. It is only after 3 years that you are completely in the clear if no action has been taken.
However if you are not issued with a notice of Court appearance within the six months and you get it after this, you can appeal and the PF would have to give his reasons for the delay. I received mine at just over five months from the date of the offence.
