A friend was stopped this morning for not wearing a seat belt, stupid mistake and not making excuses, however the fixed penalty notice served states the date of offence as 16/11/11, not 16/11/13 is this still enforceable and if not what would be the next course of action ?

I think not Something similar happened to me a few years back and the proceedings where dropped once they where made aware of it. But then I'm no lawyer.

I'd have thought the same though my father in law was sent a fixed penalty notice for exceeding the speed limit in a "(insert wrong car make and model) private reg no. ..........."
Took some advice and although the notice was factually incorrect the camera logs were able to show it was his car. Maybe the same with the log of the stop?

After a little research it seems that the fixed penalty notice is offered as an alternative to a full charge for the offence, so if you choose not to pay, or fault it by this method they can still take you to court through the formal charge, ( which of course will have the correct date ) therefore they can ignore the FP ticket completely if you contest it.
However I do question the basic ability of the said officer when even after being given ID he fails to spell the name correctly, fails to identify the correct street name where the offence took place and fails to get the date correct, basic literacy and attention to detail is obviously not part of the job requirement, whereas attitude seems to be more important.
I fail to see why the unemployment figures are so high if this is the standard required to administer the £100 fine.

So if they employed an on the ball clever clogs instead of this obvious idiot, what would that do to the unemployment figures??

I would think that a decent lawyer would be able to get the ticket thrown out, but then a decent lawyer will cost much more than the fine (& your not guaranteed to win). Unless the points take you into license loosing territory It's probably worth a call or initial enquiry but might be a case of taking it on the chin
