Stopped outside a kilt hire shop - on double yellows. Collected my kilt jacket when I realised I needed to buy a tie. Looked out the window, no yellow perils going about. Nipped upstairs to the shop and by the time I came back there was a yellow peril just printing one out. I try talking out of it....

"Sorry sweetheart...I've printed it out......beautiful car....can I take a picture?"
"Only if you take back your ticket"

She then takes out her camera and takes pic...with me £30 poorer.
Now the grey area....she never issued my car with the ticket...just handed it to me but then there's no doubt I was on double yellows with that pic.

Lesson learnt, you are never allowed to park on double yellows.

And you have been issued with the ticket, so no need to put it on your car.


Edit to add: I've just recieved a letter saying I have a parking ticket to pay for, but I never got a ticket, there was not one on the car. I've phoned up to ask for the photo, but been told the camera was faulty!

the ticket has to be on the car for it to count (i believe), in that situation you should always drive off. Ive had them stand in front of the car, i was in a rs4, i sunk the boot and he soon moved out of the way!

Surely if it's handed to you then they don't have to put it on the car though

I think all parking wardens now have digicams as standard issue, I have seen them taking pics of cars they have ticketed outside my office.

If the photo clearly doesnt show the ticket on the car I imagine you would have a valid case for saying you never had a ticket when the demand for cash comes in.

Not worth the hassle avoiding it....just pay it

there are legal implications here:

digital pictures are not admissible in court as proof (where this leaves speed cameras I don't know) only 'proper' photos. This is why, if you are involved in an accident, it's an idea to have a disposable camera in the glovebox, not a digi.

I don't see how a traffic warden's digi pic can be used as evidence when a member of the public can prove nothing with a digi pic. (probably one rule for one, one for t'other) I believe the reason is the risk of tampering or editing of the photo.

I have often used digital photos as evidence in court and intend to do so next week.

That having been said I don’t do criminal work and no one has ever objected to photos I have sought to introduce.

nicola (my girlfriend) just got a ticket in tesco's. they have the rule of free 2 hour parking. However, she works nearby to tesco's and has an official parking permit allowing her to use the car pack for work parking, which she has done for 2 years. She went out at lunchtime and has got a £20 ticket for having a wheel on the white line. (she claims because the car next to her was too far over, not that she was a bad parker, i dont believe her )

Ticket will have come from Tesco rather than the local authority, I assume?

If so put it in the bin. They have no right to issue tickets and have no way to make you pay them.

i think tesco out source there parking enforcement. I havent seen the ticket, will read it when i get home from work

Don’t think it matters that they outsource it, I’m no expert but understand that only the Council / Police can issue valid tickets. If it is private land then any ticket issued is a try on.

The ticket will undoubtedly be full of tough talk but it’s almost certainly a load of balls.

Be intrested to hear what they say anyway.

In Englandshire it's a different story, with clamping being legal, etc.
