How is a Cat B road legal?
(Cat B is where the vehicle is no longer safe to put back on the road and must be broken or crushed. These can only be sold to registered dismantlers with an EPA waste licence. They are actually sold as parts and are no longer considered as a vehicle. There is no economic consideration involved, purely a safety one.)

From what I understand Cat B is only a recommendation by the Association of British Insurers that it's not economically feasible to return the car to the road (and in most cases it won't be) there is no legal reason why the car cannot be repaired and returned to the road, subject to the correct vehicle inspection being passed.
Take these with a pinch of salt, but could be true:
I read that there is a code of conduct between salvage repairers and insurance companies, but private individuals can have an easier time of it.
I've also read that there is an unwritten rule that a death in a car accident leads to the car becoming Cat B even if the damage isn't that bad.
I guess when you think about it, safety doesn't necessarily come into it. Insurance companies don't do any form of approved safety checking on damaged cars. Surely it's all about economics - obviously beyond the lots of damage = hard to repair and possibly a danger.
The auction states:
"This car can be exported and be worth the full value over sea please don't send any silly offers or you will be refused." (though it's false as for most of the world, the steering wheel is on the wrong side!)
- this is exactly what the seller will be looking for. Someone in Europe to export the car, then hold on to it for a bit / re-import it to the UK with a clean bill of health..
Still going to be a hard sell, a 130k for a repaired write off, a car with a wrap hiding who knows what underneath, a car with the potential to be very, very expensive if something goes wrong.
Of course, the auction also states (badly..)
"This car was only pannel damage was never chasis damage "
Quite conceivable to have 2 (or more) 458s in the same yard, and to cheaply make one out of the bits I'd imagine...

A CAT B car can be put back on the road if the chassis is not damaged.
N1 TUT was written off as a CAT B as the Assessor assumed that the chassis was damaged when in fact it was not. As you say Simon I could not bid for it when it came up at Auction but got a certain Rocky to bid for me. He screwed me over, I had the highest bid in so he just bid above it, believe he had a deal with Stormin Norman who put it back on the road.

The VIC system was abolished last year and this is now the situation from the GOV.DVLA site.
Write-off categories.
There are 4 categories your vehicle can fall into if it’s written off. What you do next depends on which category it’s in.

A Can’t be repaired Entire vehicle has to be crushed
B Can’t be repaired Body shell has to be crushed, but you can salvage other parts from it
C Can be repaired, but it would cost more than the vehicle’s worth. You can use the vehicle again if it’s repaired to a roadworthy condition.
D Can be repaired and would cost less than the vehicle’s worth, but other costs (eg transporting your vehicle) take it over the vehicle’s value. You can use the vehicle again if it’s repaired to a roadworthy condition.
