As far as I am aware, raised platforms and decking are now permitted development and he would not require planning permission, so you may find he puts it in and there is nothing that can be done about it anymore.. Bit of a blow if he is aware of the recent changes to the PD regs..

I would get that on a 12 ft placard and put it in the garden for the summer months :-) Obviously not in a way that might obscure his view of your garden, or anything :-)
