Depending on the type of write-off whilst you may be the owner of the car they may also not be obliged to ever give it back to you - in fact they may be obliged to make sure it is dismantled. So what you own is a car that can never be given back to you - hence it's OK for them to start dismantling it or sell it on for salvage.

The outcome is inevitably going to be that they give you some money - you'll need to haggle about how much, but you were never going to get your car back.

IMHO it's not worth worrying about that part - just keep haggling about the money - of course you could call them and say that you've decided you would like your car back and see what they say - remember, in the first instance the person you talk to is unlikely to be aware of the fact that the car is already in bits :-)

It may be true that it isn't his car anymore but surely he's entitled to get things like the mobile phone holder back as they aren't part of the car! I'd get on to the seller and ebay and tell them to remove the advert until it's sorted.

True enough - not sure about personal posessions - obviously they should remain Iain's - I was only thinking about the car itself.
