“Procurator fiscal” shall mean and include the procurator fiscal of the court having such jurisdiction.
[F2“Road” shall mean and include any way, other than—
(a)a waterway; or
(b)without prejudice to section 100(c) (damage to roads by fire) or 129(4) (camping in a road) of the Roads (Scotland) Act 1984, a road within the meaning of that Act.]

I like not having trespass laws. What I see when people from the south move into our rural location is their gates and video cameras. Its the most unwelcoming and unfriendly setup possible then complain they are not made feel welcome.
I like being able go camping anywhere or walking anywhere. As long as people are not disrespectful and its not abused its not an issue.
Maybe Im too old school?

I personally think the non-trespass laws are rediculous, it means someone can come onto your property, stand at your window looking in, walking across fields with expensive livestock & horses which causes stress, the list is endless!!

What if someone was wandering around your garages and barns, they are allowed to, would you leave them to it??

The amount of hassle we have had from local rural people has been enough to make us dislike living here!!

Plus with local rural thefts of oil and other bits and pieces from barns. sheds etc I think there is a definate need for security.

Your maybe looking into this too much. No one can go in to your sheds garages nor can they freely walk on the immediate land around them. This is the same for all of your buildings so they cant go into your garden freely and look through your window. They can also not go onto land with crops and cannot cross your land with beasts. They can however picnic on unused land or cross the fields for access etc.
I used to do a lot of hiking around the west coasts and without this rule would have meant relying on national parks etc.

Anyway, to end the story, he was at the workshop on Saturday, seen by the guys at the garage looking in the windows etc, so i phoned him back, he said it was not him, however, he did fully apologise for everything he did, several times.

Done and dusted now, and all points brought up here taken on board.

Faults on both sides i guess, a mistake that will not happen again I hope.

Trespass does exist in Scotland. There is a right to roam but it doesn't cover gardens and suchlike...
