But they are still responsible for such damage, in the same way that if someone wheeled their wheely bin into your car they would be responsible. See also the posting of the home insurance covering you for public liability, which covers this case I think. Agreed, but remember many many drivers break lots of rules of the highway code every day, sometimes without realising it and generally without ever being cautioned or prosecuted. So if it's draconian enforcement you want, that might spoil many people's days. Meanwhile if it's application of common sense you want, then I would agree.
